Parts of Vehicle Covered by This Limited Warranty

The following parts and labor are covered by this Limited Warranty if a Mechanical Breakdown has
occurred.

ENGINE (Gas/Diesel): All internally lubricated parts within the engine plus the cylinder heads, engine block, engine mounts, flex plate, flywheel and ring gear, harmonic balancer, intake and exhaust manifolds, oil dipstick and tube, oil pump, oil pump drive sprocket, timing chain/belt, and timing chain tensioner. The oil pan and valve covers are only covered if damaged by an internally lubricated part.

TURBO/SUPERCHARGER: All internally lubricated parts. Housing is only covered if damaged by an internally lubricated part.

AUTOMATIC TRANSMISSION: All internally lubricated parts, torque converter, transmission mounts, vacuum modulator, all gears, governor, oil pumps, clutch plates, shafts, internal valves, rings, servo units, friction and steel drums, bearings and bushings, bands. Transmission case is covered if damage is due to the failure of an internally lubricated part.

MANUAL TRANSMISSION: All internally lubricated parts, all gears, all bearings, main drive gear, internal shifting components, synchronizing drum, shafts and spacers, main shaft, bushings. Transmission case is covered if damage is due to the failure of an internally lubricated part.

DRIVE AXLE ASSEMBLY (Front & Rear): All internally lubricated parts within the drive axle housing plus the center carrier bearings, constant velocity joints, double offset joints, drive shaft/yokes, locking hub mechanisms, propeller shafts, and universal joints. The drive axle housing is only covered if damaged by an internally lubricated part.

TRANSFER UNIT: All internally lubricated parts within the transfer case. Transfer case is only covered if damaged by an internally lubricated part.

SEALS & GASKETS: On all listed components are covered. Including Axle gasket(s), CV joint boot(s), cylinder head gasket(s), differential gasket(s), exhaust manifold gasket(s), front crankshaft seal(s), hub or wheel bearing seals, intake manifold gasket(s), oil pan gasket, output shaft seal, rear main seal, shifter seal, speedometer cable seal, steering pump shaft seal, timing cover gasket, transfer case seal(s), transmission pan gasket, valve cover gasket.

Towing Reimbursement Benefit

In the event of a Mechanical Breakdown covered by this Limited Warranty, Administrator will reimburse You a maximum of seventy-five dollars ($75) per occurrence for towing expenses incurred. A detailed receipt must be submitted to the Administrator before reimbursement will be made. No Deductible will apply to this benefit.

Terms and Conditions

  1. Protect the Vehicle from further damage. This Limited Warranty will not cover damage caused by continued operation after a Mechanical Breakdown occurs.
  2. You must return Your Vehicle to Dealer/Issuer’s service department for repairs. If You cannot return to Dealer/Issuer’s service department, You must contact the Administrator within a reasonable period of time at 800-548-1875 for instructions before any repairs can be made to Your Vehicle.
  3. Provide all maintenance records and supporting receipts to Dealer/Issuer’s service department or, if directed by Administrator in Number 2 above, to a Licensed Repair mFacility for review by the Administrator.
  4. Inform the Dealer/Issuer’s service department or, if directed by Administrator in Number 2 above, the Licensed Repair Facility, that it must telephone the Administrator at 800-548-1875 to obtain authorization to proceed with covered repair(s). Authorization must be obtained prior to proceeding with any repairs.

NO CLAIMS SHALL BE PAID WITHOUT PRIOR AUTHORIZATION FROM THE ADMINISTRATOR. YOU ASSUME ALL LIABILITY FOR PAYMENT OF REPAIRS THAT ARE NOT AUTHORIZED BY THE ADMINISTRATOR. The Administrator reserves the right to inspect the Vehicle prior to the performance of a repair or replacement. During the Term of this Limited Warranty, You must notify the Administrator of any failure, malfunction or defect on any part(s) or system(s) indicated in PARTS OF VEHICLE COVERED BY THIS LIMITED WARRANT and You must thereafter deliver the Vehicle covered by this Limited Warranty to Dealer/Issuer’s service department for any covered repairs to be done under this Limited Warranty. You must pay for all expenses (plus applicable sales taxes) for repairs that are not covered under this Limited Warranty.

All implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are hereby limited to the same duration of time as the express Limited Warranty stated herein. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to You.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so any such limitation or exclusion for incidental or consequential damages disclosed in this Limited Warranty may not apply to You. This Limited Warranty gives You specific legal rights, and You may also have other rights which vary from state to state. This is a Limited Warranty and it is the only warranty made by Dealer/Issuer on this Vehicle. There are no other agreements with respect to warranties on the purchased Vehicle between You and Dealer/Issuer.

Administrator: The Administrator performs administrative oroperational mfunctionsrelated to this LimitedWarranty.National Auto Care Corporation is the Administrator for the Limited Warranty. National Auto Care Corporation may also appoint a company to assist it with the provision of some of the administrative services for this Limited Warranty.

Commercial Use: Any vehicle used for the business purpose of livery, farming or ranching, pushing, pulling, hauling material of any kind, route work, job site activities, service or repair work, or which has been issued commercial plates in the state in which it is titled, or which advertises a commercial enterprise with signage on said vehicle, fleet or pool vehicles, or vehicles used by government entities or municipalities.

Dealer/Issuer: The Dealer/Issuer who is identified as such on the entity identified in the Dealer/Issuer Information section on page 1 of this Limited Warranty. The Dealer/Issuer is liable for the payment of repairs authorized or covered by this Limited Warranty.

Licensed Repair Facility: A repair facility with a federal employer identification number (FEIN).

Mechanical Breakdown: The inability of any covered parts or componentsto perform the functionsfor which it was designed due to defectsin material or workmanship. The manufacturer has established tolerances for the express purpose of defining mechanical breakdown and serviceability; when specifications exceed these manufacturer’s tolerances, a mechanical breakdown will be considered to have occurred.

Term: The number of years or miles listed on Terms of Limited Warranty section in page 1 of this Limited Warranty.

Vehicle: The auto or truck listed on the Vehicle Information section on page 1 ofthis LimitedWarranty. The Vehicle musthave less than 75,000miles at Vehicle Purchase Date. The Vehicle model year must be less than six (6) years from current year.

Vehicle Purchaser (You, Your): The person identified in the Vehicle Purchaser Information section on page 1 of this Limited Warranty.

Vehicle Purchase Date: The date identified in the Vehicle Information section on page 1 of this Limited Warranty.

You agree and understand that this Limited Warranty is not a policy of insurance, norisit a vehicle service agreement and that the Administrator of this Limited Warranty is acting on behalf of the Dealer/Issuer. The Dealer/Issuer is liable for the payment for the payment of repairs authorized or covered by this Limited Warranty.

This Limited Warranty is subject to rules and regulations as may be devised by the Federal Trade Commission and any applicable Limited Warranty statutes in the state where this Limited Warranty is issued.

THIS LIMITED WARRANTY CANNOT BE WAIVED AND IS NON-CANCELLABLE.

THIS LIMITED WARRANTY CANNOT BE TRANSFERRED OR ASSIGNED TO ANOTHER PERSON OR VEHICLE.

This Limited Warranty is available to You only at the time of Vehicle purchase and may not be made available by Dealer/Issuer to You after Vehicle Purchase Date.

You must follow the manufacturer’s maintenance requirements. This includes, but is not limited to, engine oil changes, transmission services and any other services recommended or required by the manufacturer. Keep all maintenance records and receipts.

The total liability of this Limited Warranty is limited to the regional actual cash value (ACV) of the Vehicle less any applicable deductible. Regional ACV is calculated as of the most recent repair date by referring to the regional ACV identified for Your postal zip code in a nationally published estimating guide.

The following are excluded from coverage under this Limited Warranty:

  1. Any part(s) or system(s) of the Vehicle not listed in SECTION 2.
  2. Any REPAIR OR REPLACEMENT MADE WITHOUT PRIOR AUTHORIZATION FROM THE ADMINISTRATOR.
  3. Any repair or replacement made outside the United States orCanada.
  4. Any repair(s) if the odometer has been tampered with, altered, disconnected (for other than routine repairs), or is inoperative as of the Vehicle Purchase Date or more than fifteen (15)days.
  5. Any part where failure is causedby:
  6. failure to service the covered vehicle as specified by the vehicle’s manufacturer, use of insufficient or improper fluids, coolants, or lubricants, or any other improper servicing.
  7. competitive driving or racing, or pulling a trailer with a gross weight in excess of 2000 pounds (unless the listed Vehicle is equipped as recommended by the manufacturer).
  8. accidental loss or damage, collision or upset, falling missiles or objects, fire, theft, larceny, hail, explosion, lightning, earthquake, windstorm, water, flood, freezing, malicious mischief, vandalism, riot, civil commotion, negligence or misuse.
  9. the failure of a non-covered part or fluid contamination (i.e. fuel, water, or foreign matter).
  10. Resultant damages caused by seals and gaskets, fluids and lubricants, adjustments, alignments (except when required in connection with the repair or replacement of a covered part), manual clutches.
  11. Mechanical Breakdowns covered by a manufacturer’s recall, factory bulletins, any other limited warranty or service agreement.
  12. Any repair for the purpose of correcting the engine compression or correcting oil consumption when a Mechanical Breakdown has not occurred. Valve grinding and/or worn rings are also not covered.
  13. Damage to a non-covered part by a covered part(s) failure, or to a covered part by a non-covered part(s) failure.
  14. Vehicle which has had a snow plow or related operating hardware attached at any time.
  15. Vehicle modified or altered from original manufacturer specification in a way that is not approved by the manufacturer or if You are using Your Vehicle in a manner not recommended by the manufacturer including but not limited to: Custom or add-on part(s), all frame or suspension modifications, lift kits, any tire size that is not recommended by the manufacturer, emissions and/or exhaust systems modifications, engine modifications, transmission modifications, and/or drive axle modifications, conversion van components, or conversion vehicle components.
  16. Consequential damages, damages to property, damages for loss of use, loss of time, loss of profits, or income, or any other incidental damages.
  17. Vehicle used for Commercial Use.
  18. Charge for maintenance, rental, or roadside services.
  19. Any Mechanical Breakdown caused by rust, corrosion or overheating.
  20. Ineligible Vehicle Makes (including but not limited to): Alfa Romeo, Aston Martin, Bentley, Bugatti, Daewoo, Ferrari, Fisker, Lamborghini, Lotus, Maserati, McLaren, Noble, Pagani, Peugeot, Renault, Rolls Royce, Saab, any other makes that are not listed in Class 1 or 2.
  21. Any Vehicle not issued a 17 character VIN (Vehicle Identification Number) from the Manufacturer of origin. Vehicles modified from original manufacturer’s specifications are not eligible.
  22. Trucks, Utility Vehicles, Vans exceeding one ton rating Vehicles equipped with Rotory Engines. Limited production vehicles
    Vehicles that have been issued a branded title. Including but not limited to: salvage, salvage/refundable, salvage theft, assembled, dismantled, scrap, fire, flood, physical damage, saltwater, frame change, motor change, body exchange, junk or parts only.
  23. “Gray Market”, “Lemon Law” or “Kit Car” vehicles.
    Commercially used or commercial vehicle types. Including but not limited to: (see definition below)
    Passenger: Ambulance, Cab & Chassis, Hearse, Incomplete Passenger, Limousine.
  24. Truck: Ambulance, Armored Truck, Auto Carrier, Bus, Cargo Cutaway, Cutaway, Flat Bed/Platform, Forward Control, Gliders, Hearse, Incomplete Chassis, Incomplete Ext Van, Incomplete Passenger, Limousine, Motorized Cutaway, Parcel Delivery, Stake or Rack, Step Van, Tandem, Tilt Cab, Tilt Tandem, Tractor Truck (Gas) Tractor Truck (Diesel)
  25. Commercial Use is defined as: any vehicle used for the purpose of livery, farming or ranching, pushing, pulling or hauling material of any kind, snow plow usage, route work, job-site activities, service or report work, has been issued commercial plates in the state in which it is titled, or advertises a commercial enterprise with signage on said vehicle.
